
TERMS & CONDITIONS
These Terms and Conditions govern the relationship between you (“the Client”, “you”, or “participant”) and Locas Only Pty Ltd (“Locas Only”, “we”, “us”, or “our”) when booking and participating in any trip, retreat, tour, or travel experience organized by Locas Only.
By booking a trip with Locas Only, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Role of Locas Only
Locas Only designs and curates travel experiences and acts as an intermediary between clients and independent third-party service providers such as hotels, transport companies, guides, activity providers, and other tourism operators (“Suppliers”).
All services are provided by independent third-party suppliers who operate under their own management, licenses, safety standards, and insurance policies. Locas Only does not own, control, or operate these suppliers and therefore cannot be held responsible for the acts, omissions, or negligence of these independent service providers.
2. Booking and Acceptance
A booking is considered confirmed once:
• A completed booking form is submitted
• The required deposit or full payment has been received
• You receive written confirmation from Locas Only
By confirming your booking, you agree to these Terms and Conditions. Locas Only reserves the right to decline any booking at its discretion.
3. Deposits and Payments
Trips may require a non-refundable deposit to secure your place.
The remaining balance must be paid by the deadline specified in your booking confirmation.
Failure to complete payment by the due date may result in cancellation of your booking and forfeiture of your deposit.
Prices may change prior to booking confirmation due to exchange rates, supplier costs, or external factors.
4. Cancellations by the Client
All cancellations must be made in writing.
Deposits are non-refundable unless otherwise stated.
Cancellation fees may apply depending on the timing of the cancellation and the policies of the third-party suppliers involved.
Where possible, Locas Only will attempt to recover refundable amounts from suppliers. However, refunds are not guaranteed and will depend on the terms and conditions of each supplier.
Locas Only is not responsible for any non-refundable costs such as flights, visas, insurance, or other independently booked services.
5. Minimum Participant Requirement
Some Locas Only trips require a minimum number of participants in order to operate.
If the minimum number of participants is not reached, Locas Only reserves the right to cancel the trip.
In such cases, participants will receive a 100% refund of all payments made directly to Locas Only.
Locas Only is not responsible for additional expenses incurred by participants, including but not limited to flights, visas, insurance, or personal travel arrangements.
6. Force Majeure
Locas Only shall not be held responsible for failure or delay in the performance of its obligations when such failure is due to events beyond its reasonable control, including but not limited to:

natural disasters
-
extreme weather conditions
-
earthquakes, landslides, or floods
-
pandemics or health emergencies
-
government actions or travel restrictions
-
political unrest or civil disturbances
-
strikes or transportation disruptions
In such circumstances, Locas Only will make reasonable efforts to modify the itinerary, postpone the trip, or offer alternative arrangements. Refunds, if applicable, will depend on recoverable amounts from third-party suppliers.
7. Changes or Cancellation by Locas Only
While every effort is made to operate trips as planned, Locas Only reserves the right to modify itineraries or cancel trips due to circumstances including but not limited to safety concerns, supplier availability, weather conditions, or operational requirements.
If a trip is cancelled by Locas Only before departure for reasons other than minimum numbers not being reached, participants may be offered:

a transfer to another trip
-
a credit for a future trip
-
or a refund of payments made to Locas Only, excluding non-recoverable supplier costs.
Locas Only is not responsible for additional costs incurred such as flights, visas, insurance, or personal expenses.
8. Travel Insurance
Comprehensive travel insurance is mandatory for all participants. Your policy must include coverage for:

medical emergencies
-
emergency evacuation
-
trip cancellation
-
personal liability
-
loss or theft of personal belongings
Participants may be asked to provide proof of insurance before departure.
Participants are solely responsible for ensuring their travel insurance policy provides adequate coverage for the destination, activities, and duration of their trip. Failure to obtain adequate travel insurance is done at your own risk.
9. Health and Fitness Requirements
Many Locas Only experiences involve physical activities such as hiking, trekking, yoga, outdoor exploration, and travel in remote areas.
Participants must ensure they are physically and medically fit to participate in the activities included in the trip.
You must disclose any relevant medical conditions, injuries, allergies, or health concerns prior to travel.
Participants are responsible for assessing their own physical fitness and ability to participate in all planned activities.
Locas Only reserves the right to refuse participation if a participant’s health condition may pose a risk to themselves or others.
10. Assumption of Risk
Travel and adventure activities inherently involve risks that may include, but are not limited to:

altitude sickness
-
slips, falls, or injuries
-
remote medical access
-
unpredictable weather
-
wildlife encounters
-
transportation accidents
-
political or social instability
By participating in a Locas Only trip, you acknowledge and accept these risks voluntarily.
Participants may be required to sign an additional liability waiver and risk acknowledgment form prior to participation.
11. Limitation of Liability
To the fullest extent permitted by law, Locas Only shall not be liable for:

injury, illness, or death
-
loss or damage to personal property
-
delays or disruptions to travel plans
-
acts or omissions of third-party suppliers
-
events beyond our reasonable control
This includes but is not limited to incidents arising from transportation, accommodation, activities, or services provided by independent suppliers. Nothing in these Terms excludes rights that cannot be excluded under applicable law, including Australian Consumer Law.
12. Supplier Responsibility
All accommodation providers, transport operators, activity providers, guides, and other suppliers used by Locas Only are independent contractors. Each supplier operates under its own terms, licenses, and insurance policies.
Locas Only is not responsible for the operational decisions, actions, or negligence of these independent suppliers.
13. Itinerary Changes
Travel itineraries may be adjusted due to weather, safety considerations, local conditions, or operational factors.
Participants acknowledge that flexibility is required when travelling in remote or developing regions.
Locas Only reserves the right to modify activities, routes, accommodations, or schedules when necessary to ensure the safety and wellbeing of participants.
14. Passports, Visas and Entry Requirements
Participants are responsible for ensuring they have valid passports, visas, vaccinations, and any other documentation required for travel.
Locas Only is not responsible for denied entry, visa refusals, or travel disruptions caused by incorrect documentation.
15. Personal Conduct
Participants are expected to behave respectfully towards fellow travellers, guides, and local communities.
Locas Only reserves the right to remove a participant from a trip if their behaviour is deemed unsafe, disruptive, or inappropriate.
In such cases, no refund will be provided.
16. Photography and Media
During trips, photos or videos may be taken for promotional purposes. By participating in a Locas Only experience, you grant permission for Locas Only to use images or videos in marketing materials unless you notify us otherwise in writing.
17. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the jurisdiction of the courts of New South Wales.
18. Acceptance of Terms
By booking a trip with Locas Only, you confirm that you:
